Eldritch Oak – Vendor & Advertising Agreement

This Vendor & Advertising Agreement (“Agreement”) sets out the terms and conditions between Eldritch Oak (“we,” “our,” or “us”) and you, the Vendor or Advertiser (“you” or “your”).
By purchasing a Vendor Subscription or an Advertising Package, you agree to be bound by this Agreement, which comes into effect automatically upon payment.
1. Scope of Agreement
1.1 This Agreement governs your use of Eldritch Oak’s platform to sell products, provide services, or display advertising.
1.2 It is not necessary for this Agreement to be physically signed. Acceptance is automatic and binding from the moment payment is received or free packages are in effect.
2. Vendor & Advertiser Obligations
2.1 Compliance: You agree to comply with all applicable laws, regulations, and Eldritch Oak policies.
2.2 Content: All product listings, services, and advertisements must be lawful, accurate, and not misleading. Eldritch Oak reserves the right to remove or refuse any content.
2.3 Responsibility: Vendors are solely responsible for order fulfilment, returns, refunds, and customer service relating to their products. Advertisers are responsible for ensuring their adverts meet our technical and content guidelines. Currently all adverts are manually added to the site, if there are mistakes then please contact Eldritch Oak.
3. Fees & Payment
3.1 Payment for subscriptions and advertising packages is due upfront.
3.2 Fees are non-refundable unless otherwise required by law.
3.3 Eldritch Oak may change its pricing from time to time. Continued use after notice of price changes constitutes acceptance.
4. Intellectual Property & Usage Rights
4.1 You retain ownership of your content but grant Eldritch Oak a worldwide, royalty-free license to use, display, and promote your content within the platform.
4.2 You warrant that you have the rights to any content, trademarks, or images you upload or advertise, you may watermark your images if you feel this is appropriate. Some images may be down graded in quality to maintain space and stop illegal repurposing of the image.
5. Term & Termination
5.1 This Agreement begins when payment is made and continues for the duration of the subscription or advertising package purchased.
5.2 Eldritch Oak may suspend or terminate your account without refund if you breach this Agreement or our policies.
6. Liability & Indemnity
6.1 Eldritch Oak provides the platform “as is” and makes no guarantees of sales or advertising results.
6.2 You agree to indemnify Eldritch Oak against any claims, damages, or losses arising from your products, services, or advertising content.
6.3 Our total liability to you will not exceed the total fees paid by you in the 12 months preceding the claim.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
8. General Provisions
- This Agreement is the entire understanding between the parties.
- Eldritch Oak may update these terms at any time, and continued use of the platform constitutes acceptance.
- No waiver of any breach shall be deemed a waiver of future breaches.

By paying for a Vendor Subscription or Advertising Package, you confirm that you have read, understood, and agreed to the terms of this Agreement.

- Eldritch Oak is proud to shoulder the costs of advertising and running the marketplace to reach a wider public. We ask that you, in turn, help spread the word about Eldritch Oak through your friends, family, customers, and networks.
- Please support fellow sellers, Eldritch Oak and customers by reviewing products and stores.
This mutual support helps every small business on the platform grow together.
Rules of Conduct
- Do not spread false rumours, misleading information, or inflammatory comments about Eldritch Oak or its vendors.
- Do not engage in behaviour that disrupts the community or harms the reputation of other members.
Breach of Agreement
If you break these rules or the contract terms, Eldritch Oak reserves the right to:
- Remove your account from the platform.
- Suspend your ability to sell products or advertise.
